1. General
FORGANISER NV, registered with the Crossroads Bank for Enterprises under number 0634.966.453, with its registered office at 2000 Antwerpen, Namenstraat 13-15, hereinafter referred to as "FORGANISER", is the developer and owner (or at least holds the required rights of the developer and owner) of an online platform, consisting of custom-written software, for which users can register, and which is used in the context of flexible employment.
FORGANISER's customers, and therefore the licensees on the platform, are employers who wish to use the software developed by FORGANISER for their staff administration, scheduling and payroll administration.
You are about to register as a user in FORGANISER's software in order to connect with one of the licensees as employer.
As FORGANISER enters into no commitments towards you, you cannot in any way hold FORGANISER liable for the non-functioning of the platform, technical malfunctions, or any other circumstance that may cause you harm. You further acknowledge that the information entered is correct, and FORGANISER is indemnified for any damage it may suffer as a result of incorrectly entered information.
FORGANISER further wishes to emphasise that if you register as a user, FORGANISER processes personal data in the context of its activities. By accepting the present document, you expressly consent to this.
Personal data means all information about an identified or identifiable person.
Processing is to be interpreted broadly and means an operation or a set of operations relating to personal data or a set of personal data, whether or not by automated means, such as collecting, recording, organising, structuring, storing, updating or modifying, retrieving, consulting, using, providing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing or destroying data.
As FORGANISER values and respects the privacy and security of personal data, these personal data are processed exclusively in accordance with (i) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, better known as the General Data Protection Regulation (GDPR), as well as (ii) all applicable national legislation.
This privacy policy aims to inform you transparently about:
(a) The controller of your personal data;
(b) The purposes for which your personal data are processed;
(c) The period for which the personal data will be stored;
(d) Your rights in relation to this processing;
(e) Our obligations in relation to this processing;
(f) Cookies.
2. The controller of your personal data
FORGANISER NV, registered with the Crossroads Bank for Enterprises under number 0634.966.453, with its registered office at 2000 Antwerpen, Namenstraat 13-15, is the controller of your personal data.
This means that FORGANISER determines the purposes of and the means for processing personal data.
FORGANISER does so in its capacity as owner of the platform on which you register, or of whose website you visit.
3. The purposes for which your personal data is processed
How? FORGANISER collects personal data through (i) voluntary provision by the data subject (via the platform or otherwise), or (ii) through the use of our website and social media (including the associated technologies such as cookies).
What? The personal data collected by FORGANISER are (i) personal identification data, (ii) identification data issued by the authorities, (iii) electronic identification data, (iv) financial identification data, (v) personal characteristics, and (vi) leisure activities and interests, (vii) academic curriculum, (viii) professional experience, (ix) national register number, (x) national register number, and (xi) images.
Why? Personal data is always collected and processed by FORGANISER with a specific purpose in mind. The purposes for which FORGANISER processes personal data are as follows: to perform the agreements concluded with its licensees.
Consequence if not provided? Providing personal data is a necessary condition to register as a user on the platform. Without providing your personal data, you cannot be registered as a user.
4. The period for which personal data will be stored
Your personal data is kept for as long as is necessary to achieve the purpose for which it was collected, in line with legal, regulatory and internal requirements in this regard, and for no longer than 2 years. This provision does not of course affect your rights as set out in section 5 below.
5. Your rights in relation to this processing
Right to withdraw consent: You always have the right to withdraw your consent as described in section 6 below. This does not affect the lawfulness of the processing prior to that withdrawal.
Right of access: You always have the right to obtain confirmation from FORGANISER as to whether or not your personal data is being processed, as well as to have access to it.
Right to rectification: You always have the right to obtain from FORGANISER, without undue delay, the rectification of inaccurate personal data.
Right to erasure: You have the right to obtain from FORGANISER, without undue delay, erasure of the personal data in the following cases: (i) the personal data is no longer necessary for the purposes for which it was collected, (ii) the consent on which the processing is based is withdrawn, (iii) the data subject objects to the processing justified by public or a legitimate interest, or done for direct marketing, (iv) the personal data has been unlawfully processed, (v) the personal data must be erased to comply with a legal obligation, (vi) the data has been obtained in connection with an offer of information society services to a child.
Right to restriction of processing: In a limited number of situations you also have the right to restriction of processing, namely: (i) when the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data, (ii) when the processing is unlawful and the data subject opposes erasure of the personal data, (iii) when FORGANISER no longer needs the personal data for the processing purposes, but the data subject needs it for the establishment, exercise or defence of legal claims, (iv) when the data subject has objected to the processing.
Right to data portability: You have the right in certain circumstances to receive your personal data in a structured, commonly used and machine-readable form, and to transmit it to another controller.
Right to object to marketing: You have the right at any time to object to the use of your personal data for direct marketing purposes.
6. Our obligations in relation to this processing
Processing principles: FORGANISER will always process personal data according to the following principles: (i) in a manner that is lawful, fair and transparent to the data subject, (ii) for specified, explicit and legitimate purposes, (iii) adequate, relevant and limited to what is necessary for the purposes for which it is processed, (iv) the data will be accurate and, if necessary, kept up to date, (v) kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data is processed, (vi) all appropriate technical or organisational measures will be taken so that the personal data is processed in a manner that ensures appropriate security, and that it is protected against unauthorised or unlawful processing and against accidental loss, destruction or damage.
Lawfulness of processing: FORGANISER is only entitled to process personal data if one of the following conditions is met: (i) the data subject has expressly given consent, (ii) the processing is necessary for the performance of a contract to which the data subject is party, (iii) the processing is required by a legal obligation of the controller, (iv) the processing is necessary to protect the vital interests of the data subject or another natural person, (v) the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority, or (vi) the processing is necessary for the purposes of the legitimate interests pursued by the controller (except where the interests of the data subject override those.
Sharing of personal data: Your personal data is only accessible within FORGANISER to employees who need to have access to that personal data as part of their duties. These employees are bound by strict internal rules regarding the processing of personal data. When FORGANISER calls on external parties for the processing of personal data, it will only use parties that provide sufficient guarantees that the processing meets legal requirements and that the rights of the data subject are protected. Your personal data may be transmitted to the following categories of recipients: IT suppliers, and service providers of FORGANISER. In addition, identification data is shared with Applozic (Stanford Financial Square, 2600 El Camino Real, Suite 415, Palo Alto, CA 94306), being the external chat function that FORGANISER has integrated to offer communication services. This is of course also passed on to the employer for whom the data subject registers as a user on the platform.

The present privacy policy may be adapted in the future, and any future changes or adaptations will always be communicated to you in advance.
Through this privacy policy we have sought to inform you transparently about your rights and about FORGANISER's obligations in the processing of personal data. If any points remain unclear, if you want further information or if you still have questions, we will be happy to help.

When you exercise your rights, your letter or email must be accompanied by a copy of your identity card or passport so your identity can be verified.
If you have complaints and/or suggestions about the way we process your personal data, we would love to hear about them. FORGANISER attaches great importance to safeguarding your rights. We also inform you that you always have the right to lodge a complaint with the supervisory authority, namely the Data Protection Authority.
If you are not satisfied with the way we process your personal data, you can inform us and you have the right to lodge a complaint with the supervisory authority responsible for data protection.
